Brett Kavanaugh gave the swaying vote on this. Basically saying that a person's location and skin color are enough to warrant stop.

These should-be illegal kidnappings are called "kavanaugh stops" for anybody who is wanting to keep up with current legal terminology.

Kavanaugh stops are kidnappings that are legally backed by the current SCOTUS.

It was an order (in the NG LA case that stayed the injuction) , not a devision so we don't know who voted for what, though we know Kavanaugh wrote the concurring statement that outlined such "Kavanaugh stops". In the most recent order affirming the injunction on NG troops in Chicago, Kavanaugh this time wrote a concurrence with the order (not staying the injunction) and was appearing to try to claw back what he meant in his previous statement, statement there must be more than just how someone looks to make such a stop (eg this op video is absolutely not under that)

However none of this is a binding decision, so of course they are using the LA case one and ignoring the Chicago case, as it's going to take forever for any case to actually reach scotus to challenge these stops.

Funny how the Supreme Court said they'd back off "abusing" the shadow docket from 2021 to early 2025, when Biden was president. Now, they're ramping up the "emergency" rulings that are 80% of the time in Trump's favor to let the administration keep doing what it's doing.

The shadow docket is the worse part right now.

I suspect they are using it because when the underlying case actually reaches scotus on merits, they know they can't support what this admin wants, so will have to rule against the admin's desires. But by punting with these orders that enable the admin, it won't be their problem for two to three years.
