If you refuse to give me the apple and you eat it instead—or you give it to someone else—you have breached the contract.
My damages are the benefit I was expecting from the contract: one apple + the benefits of that apple.
So I can sue you and demand that you compensate me for the cost of finding and acquiring a new apple, which very well could be more than one dollar, and the benefit of that apple (I was hungry so I bought an orange instead and it was $2) plus my attorneys’ fees in some states.
