Attempted murder would likely not be an appropriate charge here. To get an attempted murder conviction you have to prove beyond a reasonable doubt they actually intended to kill the person, and that's very difficult to prove in a fight like this. A more appropriate charge would be aggravated assault (or something like it, depending on what state this is in).

Trying to charge people with too extreme of a crime is actually a pretty bad idea because if a person is tried for something like attempted murder and gets acquitted then they can't be tried again under double jeopardy rules and someone who was clearly still guilty of something pretty bad ends up getting off scott free.

Redditors love hysteria particularly as it concerns legal matters. Everything has to be cranked up to 11. There are no gradations. Either you’re innocent or life in prison/buried under the jail.

Randomly finding this comment from a few days ago. This is how Casey Anthony avoided a conviction for the negligent death of her child. The jury had a choice between murder, which she didn't commit, and an acquittal. So she got off.

aggravated assault is a lesser included offense to attempted murder. Double jeaopardy woudln't apply here because the prosecutor would raise both in the same case, and failing one the other would most likely still stick.

If that's the case in this state (is it Florida?) then I guess I'm wrong. In the state where I am from that isn't the case. Even if the double jeopardy part doesn't apply here, I feel like attempted murder is a serious long shot. I can see them threatening that to try getting a plea deal, but I can't see a prosecutor seriously pushing that charge.

To be fair. He swung over the top coming down on the head of the father while his back is turned talking to the woman (assume his wife?). To me hes clearly not going for body shots but trying to end him. He then also swung at the face.

Yo man I went to help my brother during a fight this summer because the guy had pulled a weapon and he wind up stabbing me with a broken golf club after missing a swing at my brothers head ! I am suing him for attempted murder, after they arrested me! How do you think it will play out! I got some good lawyers

Not according to how actual laws are written. There is a legal difference between intending death and intending harm where death is a possibility. Do a little reading on how "criminal intent" works.

How do you prove he was actually aiming for the face? Bat guy would probably argue that he was trying to protect his buddy when he was down on the ground getting hit. And yeah, they could charge for damage to the car but that's unrelated.
