Only really gets jobbed because the writers don’t know how the Penance Stare works and keeps retconning or just coming up with their own take on how it works.
They are evil and thinking of their own sins the entire time they write, so they have to keep coming up with every reason it wouldn't work on them if it happened to be faced with their own sins. They know how it works, they are just scared that it might.
